“Win 1 of 5 Sony Entertainment Packs” Terms & Conditions
1. Information on how to enter the promotion and the prizes forms part of these terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.
2. The Promoter is The Nuance Group (Australia) Pty Limited ABN 54 068 215 341, 190 Bourke Rd, Alexandria, NSW, 2015, Ph (02) 9384 4777. ('Promoter').
3. The promotion commences at 5:00 am (AEST) on 11 June 2010 and ends 5:00pm (AEST) on 1 August 2010 ('Promotion Period').
4. Entry is open to Australian and New Zealand residents aged 18 years or over ('Eligible Entrants') excluding directors, management, employees (and their immediate families) of the Promoter and their related bodies corporate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. To be eligible to enter, Eligible Entrants must spend AU$50 or more in a single transaction, at SYD Airport Tax & Duty Free, Live to Play, MAC, The Wiggles store or Fashion Gallery outlet located inside the Sydney International Airport or at F1RST Tax & Duty Free or the Wear & When store located inside the Brisbane International Airport or F1RST Tax & Duty Free located inside the Melbourne, Cairns or Perth International Airports (each a “Duty Free Store”) or online at www.dutyfree.com.au during the Promotional Period.
6. To enter, Eligible Entrants who make a qualifying transaction in-store must fully complete an original and official entry form found at a participating store and drop it into the entry box provided in-store by 5pm (AEST) 1 August 2010. Eligible Entrants who make a qualifying transaction online must follow the prompts on www.dutyfree.com.au to the promotional entry page, input the requested details including their online purchase receipt number and submit the fully completed online entry form by 5pm (AEST) 1 August 2010.
7. Eligible Entrants will receive one entry into the draw for registering their details correctly and in accordance with paragraphs 5 and 6 above. Multiple entries permitted, subject to the following: (a) only one entry permitted per qualifying transaction; and (b) each entry must be submitted separately and in accordance with entry requirements.
8. Eligible Entrants must retain a copy of their purchase receipt(s) from purchase made in-store or online, for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Eligible Entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the physical or online store of purchase and that the purchase was made during the promotional period but prior to entry.
9. The Promoter accepts no responsibility for late, lost or misdirected entries. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants and reserves the right to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or for tampering with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves the right to request that winners provide proof of identity, proof of purchase and proof of residency at the nominated prize delivery address in order to claim their prize.
10. Incomplete, indecipherable or illegible entries will be deemed invalid.
11. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
12. The draw will take place at 12 noon (AEST) on 5 August 2010 at The Nuance Group, 190 Bourke Rd, Alexandria NSW 2015.
13. There are five prizes awarded as part of this promotion. The five valid entries drawn will each be awarded a Sony Entertainment pack valued at AU$2,978.95. The Sony Entertainment pack includes a Sony Bravia EDL55EX500 LCD Television and a 2010 FIFA World Cup South Africa Pack which includes a 2010 FIFA World Cup South Africa PSP Game, piano black PSP console, silver console pouch and FIFA stickers.
14. The result of the draw and the Promoter’s decision on all other matters are final and no correspondence will be entered into. The winners will be notified by telephone and contacted by mail within 2 days of the draw date. Winners’ name will be published in The Australian newspaper on 10 August 2010.
15. The maximum total prize pool value is AU$14,894.75. The prize values are based on the recommended retail values of the products as provided by the prize suppliers and are correct as at 1 June 2010.
16. The prize must be taken as stated and no compensation will be payable if a winner is unable to take the prize as stated. The prize is not transferable to another person (unless agreed to by the Promoter) or exchangeable for other goods and services and cannot be redeemed as cash.
17. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
18. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. The Promoter reserves the right to redraw in the event of an Eligible Entrant being unable to satisfy these terms and conditions or forfeiting or not claiming a prize. If a prize remains unclaimed on 5 November 2010 a second chance draw will be held at 12 noon (AEST) on 3 November 2010 at the same time and place as the original draw, subject to any written directions given from a regulatory authority. Any second chance draw winner will be notified by mail within 2 days and have their name published in The Australian newspaper on the 9 November 2010.
20. If for any reason the promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given from a regulatory authority) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.
21. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
22. The name and photograph of the winners may be used for promotional purposes by the Promoter in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter, unless a winner otherwise notifies the Promoter at the time of accepting their prize.
23. Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used.
24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, contractors and agents) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of a prize.
25. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter and Qantas Holidays may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. Eligible Entrants should direct any request to access, update or correct information to the Promoter or Qantas Holidays. All entries become the property of the Promoter.
26. The laws of Australia apply to this promotion to the exclusion of any other law. Eligible Entrants submit to the exclusive jurisdiction of the courts of Australia.
