HOW TO ENTER THE TOBLERONE "WIN A VESPA SCOOTER" PROMOTION (available at F1RST Tax & Duty Free - Melbourne International Airport only)
To be eligible to enter, individuals must be overseas travellers who are Australian or New Zealand residents, aged 18 years or over, and must purchase any Toblerone product from any F1RST Tax & Duty Free shop, located in the Melbourne International Airport between 5:00am AEDST on 29/11/11 and 5:00pm AEDST on 29/02/12. Individuals who make a purchase from the F1RST Tax & Duty Free online store are not eligible to enter this promotion.
Upon purchase the individual will then be eligible to receive one (1) entry form, for each qualifying transaction. If the entry form is not presented to the individual by a member of staff upon purchase, it is the individual’s responsibility to request an entry form. For the sake of clarity, individuals will be eligible to receive one (1) entry form per qualifying transaction/receipt regardless of the number of Toblerone products purchased in that transaction.
To enter, individuals must then fully complete the entry form and drop it in the in-store entry box by 5:00pm AEDST on 29/02/12.
Entrants must retain their original purchase receipt(s) for all entries as proof of purchase.
TERMS AND CONDITIONS
1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoter is The Nuance Group (Australia) Pty Limited ABN 54 068 215 341, 190 Bourke Rd, Alexandria, NSW, 2015, telephone (02) 9384 4625 ('Promoter').
3. The promotion commences at 5:00am (AEDST) on 29/11/11 and ends at 5:00pm (AEDST) on 29/02/12 ('Promotion Period').
4. Entry is open only to overseas travellers who are Australian or New Zealand residents aged 18 years or over, excluding directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, or of the agencies, participating Duty Free outlets or companies associated with this competition. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. All entry forms must include the entrant's full name, address, postcode, daytime phone number or mobile phone number and a valid email address to be eligible for entry into the promotion. Incomplete, illegible or indecipherable entry forms will be deemed invalid. It is the entrant's responsibility to inform the Promoter if their residential address, email address or phone number changes during or after the Promotional Period.
7. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per qualifying transaction/receipt; (b) each entry must be submitted separately and in accordance with entry requirements.
8. Entrants must retain their F1RST Tax & Duty Free original purchase receipt(s) as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify that the purchase was made during the promotional period but prior to entry.
9. The Promoter accepts no responsibility for late, lost or misdirected entries. The Promoter reserves the right to request the winner to provide proof of identity and proof of residency at the nominated prize delivery address in order to claim their prize.
10. The draw will take place at The Nuance Group, 190 Bourke Rd, Alexandria, NSW 2015 on 14/03/12 at 11:00am AEDST. Winner will be notified by telephone and in writing. The winner’s name will be published in The Australian on 21/03/12. The Promoter’s decision is final and no correspondence will be entered into.
11. The first valid entry drawn from all entries received will win a LX 50 Vespa Scooter. Total prize value is up to AU$5,000 (GST inclusive) including registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary from country to country and from State/Territory to State/Territory in Australia), license plates and a helmet. The winner must collect the prize from their nearest authorised Vespa dealership. The Promoter may, in its absolute discretion, accommodate the winner's colour preference, subject to availability. Additional insurance, options, petrol, delivery fees when not collected from the winner's nearest authorised Vespa dealership and all other ancillary costs are the responsibility of the winner and will not be borne by the Promoter.
12. If the winner is, through any legal incapacity or otherwise, unable to register the scooter in their own name, then the winner may assign the scooter to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the scooter is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
13. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
14. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.
15. Total prize value is up to AU$5,000 (GST inclusive). The prize is not transferable or exchangeable and cannot be taken as cash.
16. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
17. The Promoter’s decision is final and no correspondence will be entered into.
18. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
19. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
21. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
22. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
23. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers, and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
24. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
